Terms and conditions for external sellers

Registration and use of the seller account - Version 1.0, as of 24 August 2026
1. Scope
These General Terms and Conditions ("Terms") govern the registration and use of a seller account on the platform of retrocommerce GmbH, which operates the online store www.retroshirts.ch. The sale of products on a commission basis is governed by a separate individual agreement with each seller and is not the subject of these Terms.
2. Account and registration
The seller must have legal capacity and be at least 18 years old. The details provided during registration must be truthful, complete and up to date; any changes must be updated without delay. Only one account is opened per person.
3. Login credentials and security
The seller keeps their password and login credentials secret and does not pass them on to third parties. The seller is responsible for all activities carried out via their account. If there is reason to suspect that third parties have gained unauthorised knowledge of the login credentials or that the account is being misused, the seller informs the platform without delay and changes their password.
4. Permitted use
The account may not be used unlawfully or abusively. In particular, false statements, use of the account by unauthorised persons and circumventing or disrupting the platform's security measures are prohibited.
5. Suspension and termination
The seller may request the deletion of their account at any time. The platform may suspend or delete an account if the seller breaches these Terms. Existing obligations under an individual agreement remain unaffected.
6. Data protection
The platform processes the seller's personal data in accordance with the Swiss Federal Act on Data Protection (revDSG), exclusively for the purpose of opening and managing the account and handling the business relationship. Details on data processing, the rights of the data subject and retention are set out in the platform's privacy policy.
7. Liability and availability
The platform endeavours to operate reliably but does not guarantee uninterrupted availability. Its liability is limited to intent and gross negligence, to the extent permitted by law.
8. Changes to the Terms
The platform may amend these Terms. Changes will be communicated in an appropriate form. If the seller continues to use their account after the amended Terms come into force, this is deemed to constitute consent.
9. Final provisions
Should any provision be or become invalid, the validity of the remaining provisions remains unaffected. These Terms are governed by Swiss law; the exclusive place of jurisdiction is Zurich, to the extent permitted by law.
